PCG 2021/4 introduces a new concept of Gateways for professional practitioners to consider and satisfy before applying the risk assessment framework. If they are not satisfied, there is an increased chance of further compliance action being undertaken by the ATO. This session contains an overview to PCG 2021/4 and analyses the details of the two Gateways in the ATO’s new compliance approach, including:

  • A guide to applying PCG 2021/4, and who is covered by the PCG
  • An overview of the interaction between PCG 2021/4 and the PSI rules
  • An overview of the transitional arrangements
  • A detailed examination of Gateways 1 & 2
  • Common examples and features that could indicate an arrangement is not commercially driven
  • Financing arrangements, especially those at non-arm’s length, that could raise concerns
  • A look at current arrangements the ATO considers to be ‘high risk’
  • How the PCG impacts Everett and Galland arrangements.
