On October 12 2004, the Full Federal Court upheld the taxpayer's appeal against the judgement of Merkel J in Transurban City Link Limited v FCT.
The issue before the Federal Court and on appeal was whether annual Concession Fees of $31.25 million in the 1996 year of income and $95.6 million in each of the 1997 and 1998 years of income were allowable deductions to Transurban City Link Limited.
